For merchandise lost or damaged in transit, the consignee must file the freight claims directly with the delivering carrier. · All claims for shortage or damage of merchandise not resulting from transit must be delivered to Le Creuset within 20 days of the delivery of the applicable shipment by the carrier. The consignee must retain for 90 days from Le Creuset’s receipt of the claim, and permit Le Creuset to inspect and verify at its convenience: (i) all damaged merchandise and (ii) all packaging containing damaged merchandise or that should have contained merchandise alleged to be short, along with the other merchandise contained in such packaging. Any merchandise delivered in lieu of short merchandise must be identified to Le Creuset in the shortage claim and returned to Le Creuset as it directs. · Any claims for nonconforming merchandise or services must be delivered to Le Creuset within 45 days of the delivery of such merchandise or services to the purchaser from Le Creuset and must specify in detail the nature of the nonconformity.
